1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Mycustomerpilot ("Company," "we," "our," or "us") governing your access to and use of our services ("Services").

BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE OUR SERVICES.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using our Services under applicable laws
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

3. Account Registration and Security

3.1 Account Creation

  • You may register using email/password or social authentication (Google/Facebook)
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate, current, and complete information
  • One person or entity may not maintain multiple accounts

3.2 Account Security

  • You are solely responsible for all activities under your account
  • Notify us immediately of any unauthorized access or security breaches
  • We are not liable for losses caused by unauthorized use of your account
  • You must not share your account credentials with third parties

3.3 KYC Verification

Certain features require identity verification through NIN, BVN, or CAC registration. By submitting verification documents, you:

  • Confirm the authenticity and accuracy of submitted documents
  • Authorize us to verify your identity through third-party services
  • Understand that false information may result in account suspension

4. Subscription Plans and Billing

4.1 Subscription Tiers

We offer multiple subscription plans (Starter, Professional, Business, Enterprise) with varying features and limits. Plan details are available on our pricing page.

4.2 Free Trial

  • New users receive a 7-day free trial with limited features
  • Trial automatically expires after 7 days unless upgraded
  • One trial per user/business entity
  • We reserve the right to modify or discontinue trial offers

4.3 Payment Terms

  • Subscriptions are billed monthly or annually in advance
  • All fees are in Nigerian Naira (NGN) unless otherwise stated
  • Payment is processed through Paystack, Flutterwave, or Monnify
  • You authorize automatic recurring charges to your payment method
  • Failed payments may result in service suspension

4.4 Refund Policy

  • No Refunds: All subscription fees are non-refundable
  • Cancellation: You may cancel at any time; service continues until period end
  • Exceptions: Refunds may be issued at our sole discretion for service failures

4.5 Price Changes

We reserve the right to modify pricing with 30 days' notice. Continued use after price changes constitutes acceptance.

5. Acceptable Use Policy

5.1 Permitted Use

You may use our Services for:

  • Legitimate business communication and customer support
  • Marketing to contacts who have opted in
  • Automation of routine WhatsApp interactions
  • AI-powered chatbot responses for customer inquiries

5.2 Prohibited Activities

You must NOT:

  • Send spam, unsolicited messages, or bulk messages to non-consenting recipients
  • Violate WhatsApp's Terms of Service or Business Policy
  • Engage in fraudulent, deceptive, or illegal activities
  • Transmit malware, viruses, or harmful code
  • Harass, threaten, or abuse others
  • Impersonate any person or entity
  • Scrape, crawl, or reverse engineer our Services
  • Interfere with or disrupt our Services
  • Use our Services to compete with us
  • Share or resell access to our Services

6. WhatsApp Integration and Compliance

6.1 WhatsApp Business API

  • Our Services integrate with WhatsApp through official APIs
  • You must comply with WhatsApp's Terms of Service and Business Policy
  • WhatsApp may suspend or terminate your number for policy violations
  • We are not responsible for WhatsApp's actions or policy changes

6.2 Message Limits

  • Subscription plans include message limits (messages sent/received)
  • Exceeding limits may result in additional charges or service suspension
  • Limits reset monthly based on your billing cycle

6.3 Number Ownership

  • You must own or have authorization to use connected WhatsApp numbers
  • You are responsible for maintaining your WhatsApp Business account
  • We do not provide WhatsApp numbers or phone verification services

7. AI Chatbot and Data Processing

7.1 AI Functionality

  • Our AI chatbot uses OpenAI's GPT models to generate responses
  • AI responses are based on your configured knowledge base and settings
  • We do not guarantee accuracy or appropriateness of AI responses
  • You are responsible for reviewing and approving AI-generated content

7.2 Data Ownership

  • You retain ownership of all data you input into our Services
  • We process your data solely to provide Services
  • You grant us a license to use your data for service delivery
  • We may use anonymized data for analytics and improvements

8. Disclaimers and Limitations of Liability

8.1 Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • Services will be uninterrupted, secure, or error-free
  • Results will be accurate or reliable
  • Defects will be corrected
  • Third-party services (WhatsApp, OpenAI) will remain available

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Termination

9.1 By You

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial periods

9.2 By Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Fail to pay fees when due
  • Pose a security or legal risk

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.

10.2 Arbitration

Any disputes arising from these Terms or our Services shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act of Nigeria, rather than in court.
